Terms & Conditions

Please read these Terms and Conditions carefully before engaging our services or using our website. By proceeding, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services or website.

1. About Us

These Terms and Conditions govern your use of our website and the provision of gardening services by Barefoot Gardening ("we", "us", "our").

By engaging our services or using our website, you agree to be bound by these Terms. Please read them carefully before proceeding.

2. Our Services

We provide professional gardening and landscaping services including, but not limited to, garden design and planning, lawn care, planting, tree and hedge maintenance, seasonal planting, and garden clearance.

All services are subject to a site assessment and written quotation. We reserve the right to decline any job at our discretion.

3. Quotations and Pricing

All quotations are provided in writing and are valid for 30 days from the date of issue. Quotations are based on the information available at the time; additional charges may apply if the scope of work changes materially.

Prices are quoted in GBP and are inclusive of VAT unless stated otherwise. We reserve the right to amend our pricing with reasonable notice.

4. Bookings and Cancellations

A booking is confirmed once you have accepted a written quotation and, where required, paid a deposit. Deposits are non-refundable unless we are unable to carry out the booked work.

  • Cancellations made more than 48 hours before the scheduled start time: full refund of any deposit paid (excluding non-refundable deposit where applicable).
  • Cancellations made within 48 hours of the scheduled start time: a cancellation fee equivalent to 50% of the quoted job cost may apply.
  • We reserve the right to reschedule work due to adverse weather conditions or circumstances beyond our control. In such cases, we will contact you as soon as possible.

5. Payment Terms

Payment is due on completion of the work unless otherwise agreed in writing. For larger projects, a deposit of up to 30% may be required prior to commencement. We accept payment by bank transfer and major debit/credit cards.

Invoices not settled within 14 days of the due date may incur interest at 8% per annum above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998.

6. Access and Site Conditions

You agree to provide us with safe, reasonable access to the property on the agreed dates. Any hazards, restrictions, or relevant site information must be disclosed prior to commencement of work.

We are not liable for any delays or additional costs arising from conditions on-site that were not disclosed or were reasonably unforeseeable.

7. Our Liability

We carry full public liability insurance. In the event of damage caused directly by our negligence, we will take reasonable steps to rectify the issue or provide fair compensation.

  • We are not liable for damage caused by pre-existing conditions, plant diseases, or pests unless a specific inspection was agreed.
  • We are not liable for indirect or consequential losses, including loss of enjoyment or loss of use of your garden.
  • Our total liability to you shall not exceed the total amount paid for the specific services giving rise to the claim.
  • Nothing in these Terms limits our liability for death, personal injury caused by our negligence, or fraud.

8. Waste Disposal

Garden waste generated during our work is disposed of responsibly and in accordance with applicable waste regulations. Disposal of waste is included in our service unless otherwise stated in the quotation. We do not accept liability for waste incorrectly described by the customer.

9. Intellectual Property

All garden designs, planting plans, drawings, and other materials we create remain our intellectual property until full payment has been received, at which point ownership transfers to you.

All content on our website, including text, images, and designs, is the property of Barefoot Gardening and may not be reproduced without prior written consent.

10. Complaints

We take customer satisfaction seriously. If you are unhappy with any aspect of our service, please contact us within 14 days of the completion of work. We will acknowledge your complaint within 5 working days and aim to resolve it within 28 days.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We reserve the right to amend these Terms and Conditions at any time. The version published on our website at the time of your booking or enquiry will apply. We encourage you to review these Terms periodically.
